Who are you?

We were originally a group of investors who came from an online forum called the Ticker Forum. Ticker Forum was and still is comprised of a very large group of people, many of whom have worked within the financial industry, within the real estate industry, in private and public investment, in business both big and small and in the field of economics. These are people who realized early on that there was something terribly wrong with our financial system, despite the public being told repeatedly that the ‘economy was sound.’  FedUpUSA was borne out of a need to get our information out to the American public, so that they could know the truth and be encouraged to stand up and have a voice. The American People cannot be heard until they truly understand how they’re being robbed blind by the Wall Street bankers who continue to pay for the campaigns for election and re-election of those who will ensure legislation to facilitate their thievery.

FedUpUSA held its first protest in April of 2008 after the Bear Stearns ‘merger’ with JPMorgan using taxpayer dollars.

Since this occurred in the middle of a Sunday night without any vote from Congress, this was blatantly a case of taxation without representation.  It sounded like it was time to have a new Tea Party.  The rest is history.  You can read more about how we were integral in starting the movement we intended to be all about stopping the fraud, corruption, and looting and starting the prosecuting here.  It was never supposed to be about Party politics.  Later we went on to hold another protest in Washington DC as well as produce a video that was distributed to every member of Congress.

Since that time, FedUpUSA and The Market-Ticker have made appearances in national and international media, including:  CNN with Glenn Beck, MSNBC with Dylan Ratigan numerous times, Fox Business, CNBC, the UK Guardian, both French and Chinese newspapers, Capital Account, Max Keiser, and on numerous radio stations around the country.   FedUpUSA was also invited to and attended the 2011 Civility in Democracy Conference at the National Constitution Center in Philadelphia to take part in a 3-day conference tackling the difficult question of how to bring people together across political divide to discuss the urgent constitutional issues facing us today.  (Most of these media appearances are linked in the column to the left.)

The financial crisis that began in 2008 is not as complex as most people believe.  It can be boiled down to one word: corruption.  Corruption is a disease that spreads uncontrollably when the rule of law has been lost.  Our system of government was made with a division of powers among three separate branches of government, all constrained by limited scope and common-sense principles, for the sole purpose of inhibiting corruption and the inevitable rise of an elite ruling class.

Today, however, we have more than thirty-five thousand registered lobbyists in Washington DC. That’s nearly seventy lobbyists for each member of Congress.  Together they spent almost three and a half billion dollars last year — that’s over six and a half million dollars per congressman. With that money, they buy influence, not on behalf of The People, but to put forward the agendas of their clients.  Huge corporations, international banks, power brokers on Wall Street, foreign governments, media giants — the real self-appointed ruling class — their lobbyists write the bills, the congressmen work as scripted front men for tainted legislation and then they vote as they’re told.  This country was founded as a representative republic, but We The People are no longer represented.

There is no more ‘equal justice under the law’ – - there are laws written to favor the elite who pay the congressmen to write them and there are ‘exemptions’ to most laws to allow for the criminal activity of the elite.  Until the rule of law is restored, the financial crisis will not end.  The financial crisis is but a symptom of a disease that is terminal for the Republic.

What do you do with the donations?

We are a non-profit organization.  We aren’t doing this to make money.  We have no advertisers.  We have no independent source of funding.  We are a group of concerned people, all of whom do this on a volunteer basis.  Many times this takes us away from our otherwise paying careers.  It costs money to maintain a web site and we rely on the kindness of people’s donations to keep our site going.  If you find value in our web site and the information we provide, a donation of any amount is greatly appreciated.

Which party are you affiliated with?

We are a non-partisan group and firmly believe that our two main parties, both Republican and Democrat are equally to blame for the mess we find ourselves in. That being said, we also firmly believe that each and every Member of Congress who voted for the atrocity known as the The Emergency Economic Stabilization Act of 2008, H.R. 1424, as well as all of the other bailouts of companies that should have been left to fail, should have been voted OUT on November 4th, 2008 in the general elections. Unfortunately, that was not the case as many of those responsible for this horrible mess, which we are now leaving to our children, remain in office. You can find out how your Members of Congress voted.  Many of these Members of Congress willfully ignored the voices of their constituents.  This is not how our government should work.  It is not how our Constitution says it should work.  That noise you hear in the background is our Founding Fathers spinning in their graves at 60,000 RPMs.

Since both candidates for President of the United States voted for this Bailout Bill, we did not recommend voting for either of them.

We firmly believe that everyone must vote; so, we recommend finding either a 3^rd party candidate, or doing careful research on the Republican or Democrat candidate alternatives.  Review how they voted.  If they voted for any bailouts, you know they are not representing their constituents, but instead, their own interests and wallet.  Just as important, find out who funds your prospective candidate.  You can find out exactly who contributes to registered candidates at: Open Secrets .  This is a valuable resource.

We wholeheartedly encourage exploration of other parties besides the two that have had a stranglehold on American politics for decades.  One such party can be found here: Federationist.org

What can I do if I’m Fed Up?

We recommend you get active.  We have a number of organizations on our Links page , which will help you do that. We also have instructions on how to Contact Your Member of Congress.  The key is to do something other than sit around and complain.  Americans have the unique opportunity to influence and change.  Our Founding Fathers intended our government to be of The People and by The People.  The People seem to have forgotten this.  Our Congress seems to have forgotten this as well, as evidenced by their willful ignoring of the overwhelming majority of constituents who told them, loudly, they opposed the bailouts. We encourage everyone to be a part of the solution.  If you’re not, you’re merely a part of the problem.

Reaching out and educating others also helps.  For each person that can be told the truth about what we face in this economic crisis, the more inclined they will be to get active too.  Each person counts.  Last, but not least, send everyone you know to FedUpUSA.org !

FedUpUSA operates within the provisions of the Digital Millennium Copyright Act (DMCA) including Section 512, which provides a “safe harbor” provision for the system administrators and owners.

If you believe that material has been posted on FedUpUSA in violation of your Copyright or other proprietary rights, you are strongly urged to file a “takedown request” under the DMCA.

This document sets forth the requirements for filing such a complaint, where and how service may be performed, and what FedUpUSA (the owner and operator of this system) will do upon receipt of such complaints.

Please be aware that under the Digital Millennium Copyright Act electronic mail complaints are not legally binding and must be followed by a formal complaint in written form. Electronic mail complaints will be replied to with both a surface address and fax number where paper copies may be sent, or you may use the fax number above.

Please include both an email address and a fax number in your original communication; while neither is required under the DMCA (a purely written complaint is sufficient under the law) in the interest of the fastest possible response to your complaint it is strongly recommended that you transmit it by fax and include both a return fax number and email address.

Content Of DMCA Complaints And Actions Which Will Be Taken

DMCA complaints must contain all of the following in order to be acted upon in accordance with the Digital Millennium Copyright Act. Complaints lacking one or more of the following items WILL BE RETURNED as they do not comport with the legal requirements of the act.

1. The name, address, and electronic (or actual) signature of the complaining party.[512(c)(3)(A)(i)]
2. The infringing materials and their specific location on the system using a reference link or other information sufficient to locate the materials in specificity. Each posting on the system has a permanent link displayed that is unique to each individual message; inclusion of this in your complaint is sufficient to meet the requirements of the statute. [512(c)(3)(A)(ii-iii)]
3. Sufficient information to identify, with certainty, the alleged infringing works [512(c)(3)(A)(iv)]
4. A statement by the owner of the Copyright of a good faith belief that there is no legal basis for the use of the materials complained of [512(c)(3)(A)(v)]
5. A statement of the accuracy of the notice and, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner [512(c)(3)(A)(vi)].
6. It is strongly suggested (although not required by the statute) that a landline telephone number for the complaining party be included in the complaint in order to expedite resolution of any ambiguity or defect in the complaint as tendered.

Once notice is given under these provisions FedUpUSA will act expeditiously to remove or disable access to the material(s) in question. In addition, the user who posted the material will be notified of this action contemporary with its effective time and date.

Counter-Notice Provisions

A user who has material disabled or removed and believes that this material is in fact covered by “Fair Use” or is in some other way properly being used, and is not in violation of the requirements of the DMCA, may provide a “counter notice.” A proper “counter-notice” must provide the following:

1. The poster’s name, address, phone number, and physical or electronic signature [512(g)(3)(A)]
2. Identification of the material and its location before removal [512(g)(3)(B)]
3. A statement under penalty of perjury that the material was removed in error or by misidentification [512(g)(3)(C)]
4. Consent to federal court jurisdiction for adjudication of the matter, or if overseas, to an appropriate judicial body. [512(g)(3)(D)]

This counter-claim notice will be expeditiously forwarded to the complaining party.

Under the law, should a proper counter-notice be provided, FedUpUSAis required to restore the alleged infringing material in 14 days unless the claiming Copyright Holder brings suit within that time in a federal district court.

Privacy Provisions

The DMCA provides that a complaining party may subpoena the identification of a user.

It is the policy of FedUpUSA to comply with all subpoenas and other judicial process which are enforceable within the United States, State of Michigan, County of Oakland.

Therefore, should such a document be received, FedUpUSA will provide to the subpoenaing party all identification information requested that it has in its possession.

Please be aware that as this system operates without fee to the user there are no billing records available and thus it is highly likely that the “best and only” conclusive evidence of a user’s identity will be the IP address(es) from which access to the forum has been made.

Repeated Infringement

As per the Terms of Service (which can be found in the forum FAQ) repeat infringers will have their access to the forum denied.

False Claims Warning

CAUTION: Under the DMCA any person knowingly making false claims in either a DMCA Takedown Notice or Counterclaim is liable for all damages, including costs and fees, incurred by the party harmed by the misrepresentation.

It is the policy of FedUpUSA to respond aggressively to false claimants.
